1Acceptance of Terms
By accessing or using Procoach (“Procoach,” “we,” “us,” or “our”), including our website, mobile experiences, and coaching marketplace services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.
If you use Procoach on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2Eligibility & Accounts
You must be at least 18 years old to create an account, or use Procoach under the supervision of a parent or legal guardian who manages the account and consents to these terms on your behalf.
You agree to provide accurate registration information, keep your credentials secure, and notify us promptly of unauthorized access. You are responsible for activity under your account.
3Our Role as a Platform
Procoach connects learners with independent coaches. Coaches are not employees of Procoach. We facilitate discovery, booking, scheduling, communications, and payment processing where enabled—but we do not guarantee specific outcomes, skill levels, or availability of any coach or session.
Session content, coaching methods, cancellations, rescheduling, refunds, and in-person or virtual delivery are the responsibility of the coach and participating learners, subject to the coach's published policies and applicable laws.
4Learner Responsibilities
- Provide accurate profile and enrollment information.
- Arrive on time and follow coach instructions and facility policies.
- Pay applicable session fees and follow each coach's published cancellation and refund policy.
- Treat coaches and other participants with respect; no harassment or abuse.
- Parents or guardians managing child profiles are responsible for supervising minors' use of the platform and sessions.
5Coach Responsibilities
- Maintain accurate credentials, session descriptions, pricing, and schedules.
- Deliver sessions professionally and in line with advertised offerings.
- Comply with applicable laws, licensing, insurance, and venue requirements.
- Honor cancellation and refund policies you publish on Procoach.
- Protect learner privacy and use learner data only for coaching purposes.
6Booking, Cancellation & Attendance
Session bookings are confirmed when displayed in your account and, where applicable, payment is successfully processed. Coaches may set enrollment windows, capacity limits, and cancellation rules visible at booking time.
Cancellation and rescheduling are handled by the coach who offers the session. Your rights depend on that coach's published policy and the timing of your request. Late cancellations or no-shows may result in charges or no refund according to that policy. Procoach provides booking and cancellation tools, but the coach's stated terms control all session changes and refund outcomes unless otherwise required by law.
7Payments & Refunds
Payments are processed through third-party payment providers (such as Stripe). By enrolling in a paid session, you authorize charges for the listed amount plus applicable taxes or fees disclosed at checkout.
Whether a session refund is owed—and how much—is decided solely by the coach under their published cancellation and refund policy. Procoach facilitates payment processing through third-party providers but does not approve or deny coach session refunds. Contact your coach first for refund requests. Procoach does not store full payment card numbers on our servers.
Email support@joinprocoach.com for platform, account, or technical issues (such as sign-in or payment errors). Do not expect Procoach to override a coach's refund decision except where we are legally required to do so.
8SMS & Text Communications
If you opt in during registration or in account settings, Procoach may send SMS or text messages about session reminders, schedule changes, enrollment updates, and account security. Message and data rates may apply.
Consent to SMS is not required to create an account where the product allows opt-out, but some notifications may be limited without SMS enabled. You can opt out by following instructions in messages or contacting support@joinprocoach.com. See our Privacy Policy for how we handle phone numbers.
9Prohibited Activities
You may not:
- Use the platform for unlawful, fraudulent, or harmful purposes.
- Circumvent payments, fees, or booking systems.
- Scrape, reverse engineer, or overload our systems without permission.
- Impersonate others or misrepresent qualifications.
- Upload malware, spam, or offensive content.
- Discriminate or harass based on protected characteristics.
We may suspend or terminate accounts that violate these rules or pose risk to users or the platform.
10Intellectual Property
Procoach and its branding, software, and content are owned by us or our licensors. You receive a limited, non-exclusive license to use the platform for its intended purpose. Coaches retain rights to their own materials; learners may not record or redistribute sessions without permission.
11Disclaimers & Limitation of Liability
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROCOACH DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR COACH CONDUCT, INJURIES, OR DISPUTES ARISING FROM SESSIONS. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE PLATFORM IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID TO PROCOACH IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE LAW REQUIRES OTHERWISE.
12Indemnification
You agree to indemnify and hold Procoach harmless from claims arising out of your use of the platform, your sessions, your content, or your violation of these terms or applicable law.
13Governing Law & Changes
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory local law applies to you as a consumer.
We may update these terms from time to time. Material changes will be indicated by an updated “Last updated” date. Continued use after changes constitutes acceptance. Contact support@joinprocoach.com with questions.
